Heard learned counsel for the petitioners as well as the learned APP for the State.
At the outset, learned counsel for the petitioners has submitted that the petitioner no. 1, Kedar Puri, has been arrested during the pendency of this anticipatory bail petition. He, therefore, seeks permission to withdraw the anticipatory bail petition in respect of petitioner no. 1.
In view of the aforesaid submission, the anticipatory
Patna High Court CR. MISC. No.22915 of 2022(2) dt.10-10-2022 2/3 bail petition of petitioner no. 1 is dismissed as withdrawn. The petitioner nos. 2 and 3 apprehend their arrest in connection with Barharia P.S. Case No. 09 of 2022, registered for the offences punishable under Sections 341, 506, 323, 325 and 307/34 of the Indian Penal Code.
As per allegation, five named accused persons assaulted the informant on the order of petitioner no. 1 whose anticipatory bail petition has been withdrawn. Co-accused Anuj kumar @ Bullet assaulted on the head and neck of the informant. There is also allegation against petitioner no. 2 that he assaulted the informant with iron rod on his head. Learned counsel for the petitioners has submitted that there is case and counter case and petitioner no. 2 and 3 have sustained grievous injuries on their persons. He has submitted further that there is delay of three days in lodging the FIR. Considering the above-mentioned facts and circumstances and also considering the facts that petitioners have also sustained grievous injuries and they are the persons of clean antecedent, let the petitioners, in the event of their arrest or surrender within four weeks before the learned court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the
Patna High Court CR. MISC. No.22915 of 2022(2) dt.10-10-2022 3/3 satisfaction of learned A.C.J.M.-III, Siwan in connection with Barharia P.S. Case No. 09 of 2022, subject to the conditions as laid down under Section 438(2) Cr.P.C.
Office shall ensure that all defects are removed by the petitioners within the stipulated time provided in para-1 hereinabove, failing which the matter shall be brought to the notice of this Court.
