JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 24-11-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-409, 420 of the Indian Penal Code.
Petitioner is said to have embezzled huge government money and did not produce relevant papers for audit. Learned counsel for the petitioner submits that the audit has already been done and the informant of the present case has written letter to the I.O. of the present case in this regard, which is evident from perusal of Annexure-3 to the supplementary affidavit.
Perusal of annexure-3 to the supplementary affidavit goes to show that the petitioner failed to give account of Rs.
Patna High Court Cr.Misc. No.40857 of 2016 (4) dt.24-11-2016 2/2 12,37,434/- even when audit was done after institution of the present case.
Therefore, considering the above-said facts and circumstances of the case as well as submission of the parties, I am not inclined to release the petitioner on bail and accordingly, his prayer for bail in connection with Alouli P.S. Case No. 150 of 2015 stands rejected.
