2. Petitioner seeks bail, who is in custody since 09.06.2022, in connection with Jalley P.S. Case No. 65 of 2022, F.I.R. dated 20.05.2022 registered for the offences punishable under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act.

3. Allegation against the petitioner is that he fired upon the victim and the victim died on spot.

4. Learned counsel for the petitioner submits that the petitioner has clean antecedent and he has been falsely implicated in the present case. He further submits that the allegation as alleged in the F.I.R. is false and fabricated and the petitioner has not committed any offence as alleged in the F.I.R.

5. Learned APP for the State, on the other hand, on the basis of material available on record and the case diary, vehemently opposed the prayer for bail and submits that there is specific and direct allegation against the petitioner that he has shot fire upon the victim and the victim died on the spot. He further submits that the witnesses have also supported the prosecution case during investigation.

6. Considering the nature of allegation and the gravity of the offence as alleged, I am not inclined to enlarge the petitioner on bail in connection with Jalley P.S. Case No. 65 of 2022 pending in the Court of Additional Chief Judicial Magistrate-I, Darbhanga.

7. Prayer is refused.
