JUSTICE VINOD KUMAR SINHA ORAL ORDER 26-04-2017 The petitioner is apprehending his arrest in connection with Janta Bazar P.S. Case No. 22 of 2017, registered for offences punishable under Sections 341, 323, 354,448, 504/34 of the Indian Penal Code.

The allegation against the petitioner as per FIR is that the petitioner has assaulted the informant and also thrashed her on the ground and tore the salwar, out of which she became semi-naked. It has been submitted on behalf of the petitioner that the dispute arose with respect to the Nali between the house of the petitioner and the informant and dispute was with the father of the informant but the informant has lodged this false and concocted case and the allegation of outraging the modesty has been inserted only to make the case serious.

Patna High Court Cr.Misc. No.17732 of 2017 (2) dt.26-04-2017 2/2 Heard learned A.P.P. for the State also.

Having heard both sides and in view of the nature of allegation levelled against the petitioner, I am not inclined to enlarge the petitioner on bail.

The prayer for bail of the petitioner is hereby rejected. Let the petitioner surrender before the court below and make prayer for regular bail, which would be considered on its own merit, without being prejudiced by anything said in this order. It is also observed that the bail application of the petitioner shall be disposed of on the same day.
