Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 144, 379, 384, 363 of the Indian Penal Code.

The prosecution case as per the written report of the Forest Range Officer, Sasaram is that one tractor was intercepted carrying 80 C.F.T. stones, but while the tractor was being taken to the Forest Office, Sasaram, then the tractor was stopped by motorcycle born miscreants and they got released the tractor and escape from the scene. During investigation, it was found that the petitioner was the driver of the tractor.

It is submitted by the learned counsel for the

Patna High Court Cr.Misc. No.44816 of 2015 (3) dt.30-10-2015 petitioner that admittedly no recovery was made from the petitioner. Statement has been made in para-3 of the petition that petitioner has no criminal antecedent.

The aforesaid facts constitute ground for consideration of prayer for regular bail of the petitioner, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Sasaram (Darigaon) P.S. Case No. 1224 of 2014, pending in the court of learned Chief Judicial Magistrate, Rohtas at Sasaram. With this observation this application is disposed of.
