JUSTICE VINOD KUMAR SINHA ORAL ORDER 13-02-2017 The petitioners are apprehending their arrest in connection with Baisi P.S. Case No. 200 of 2016, registered for offences punishable under Section 7 of the E.C. Act. It has been submitted on behalf of the petitioners that petitioners are only the consumers and the seizure in this case is only 27 kg of rice and 11 kg wheat. The petitioners have nothing to do with the alleged offence and they have been implicated due to enmity on the instance of the Pramukh of the village. Heard learned A.P.P. also.
Having heard both sides, considering the fact that the petitioners only happens to be the consumers and no specific allegation has been levelled against them and also the recovery made is very small, let the petitioners above named, in the event of
Patna High Court Cr.Misc. No.4341 of 2017 (2) dt.13-02-2017 2/2 their arrest or surrender before the court below within a period of Six weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bond of Rs. 25,000 (Rs. Twenty Five Thousand) each with two sureties of like amount each to the satisfaction learned SDJM, Purnea, in connection with Baisi P.S. Case No. 200 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
This is further subject to condition that the petitioners will cooperate in the investigation of case and make themselves present before the police as and when required and in the event of failure on their part to appear before the Court on two consecutive occasions, their bail bond shall be liable to be cancelled.
