====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 05-12-2018 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Kursakanta P.S. Case No. 47 of 2018 corresponding to Special Case No. 272 of 2018 instituted for the offence under Section 30(a) of Bihar Prohibition and Excise Act, 2016.

It is alleged that from Indo Nepal Border, the informant along with other S.S.B. personnel intercepted some persons who were coming with bag. One person has been arrested and other managed to run away. The apprehended person disclosed his name as Dinesh Keshri. He also disclosed the name of persons who managed to run away. The police on search, recovered total 991 bottles of Dilwale Saufi each containing 300 ml. in nine bags. The name of petitioner has been disclsoed by co-accused Dinesh Keshri.

Patna High Court Cr.Misc. No.72033 of 2018(2) dt.05-12-2018 2/2 Counsel for the petitioner submits that Dinesh Keshri has already been granted bail by coordinate Bench of this Court vide order dated 27.4.2018 passed in Cr. Misc. 23104 of 2018.

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Additional Sessions Judge, Araria, in connection with Kursakanta P.S. Case No. 47 of 2018 corresponding to Special Case No. 272 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner.
