The petitioner seeks regular bail in connection with Bihiya P.S.Case no.335 of 2018 dated 2.9.2018 registered for offences punishable under Sections 363, 366, 366(A) of the Indian Penal Code.

Allegation against the petitioner is of kidnapping of the minor daughter of the informant.

Submission of the learned counsel for the petitioner is that the girl has not supported the prosecution case in her statement under Section 164 Cr.P.C. and she stated that she married on her own sweet-will with the petitioner, which will appear from the impugned order and from the ADHAR Card it appears that she is aged about 18 years and moreover, the

Patna High Court Cr.Misc. No.71694 of 2018(2) dt.12-12-2018 2/2 petitioner is in custody for about three months. The charge sheet has been submitted.

Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM-5th, Bhojpur at Ara in connection with Bihiya P.S.Case No.335 of 2018. With the aforesaid observation, this application is allowed.
