The petitioner has preferred this application for grant of regular bail in connection with Gogri Police Station (for brevity, PS) Case No 606 of 2021 dated 26.12.2021 (GR No 4203 of 2021) registered for the offence punishable under Sections 302, 201 of Indian Penal Code.

As per prosecution case, some unknown miscreants are alleged to have strangulated unknown girl to death.

No.22434 of 2023(2) dt.22-05-2023 2/2 Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case on mere suspicion. He is not named in the First Information Report and his name has surfaced during the course of investigation. There is no eye witness in this case. The petitioner is accused in one more criminal case, as stated in paragraph 3 of the bail petition in which he is on bail. He is in custody in this case since 17.11.2022.

Learned APP has vehemently opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case, period of custody as well as the nature of allegation against the petitioner, the petitioner above named is directed to be released on bail on his furnishing bonds of Rs 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Khagaria in Gogri PS Case No 606 of 2021 dated 26.12.2021 (GR No 4203 of 2021.

This application stands allowed.
