Mr.Narendra Kumar Singh, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE RAJIV ROY ORAL ORDER 19-07-2024 In this case, in Cr. Misc. No. 10200 of 2024 vide an order dated 22.2.2024, the anticipatory bail was extended to seven petitioners.
2. Now, the modification has been filed belatedly stating that though Santosh Gosai and Sanjeet Giri were able to get their bail bond executed, as all the family members have
Patna High Court CR. MISC. No.44245 of 2024(3) dt.19-07-2024 2/2 been implicated, the order needs to be modified by including relative beside the family members.
3. Learned APP opposes the prayer submitting that four weeks time was granted to surrender but the modification petition has been filed on 3.5.2024.
4. The delay is enough to reject the prayer, taking into account the fact that three of the petitioners are ladies, earlier relief was granted to them, the present petition is allowed subject to payment of Rs. 1000/- each by the petitioners herein (total Rs. 5000/-) to District Legal Services Authority, Rohtas at Sasaram.
5. Let the order dated 22.2.2024 in Cr. Misc. No. 10200 of 2024 is modified as follows:
(i) One of the bailor should be the family member/relative of the petitioners who shall provide official document to show his/her bona fide.
6. In view of the fact that the modification petition has been allowed, the time for surrender is further extended for four weeks from today.
