The petitioner is languishing in custody for the offences punishable under Section 30(a)/37(2) of the Bihar Prohibition of Liquor and Excise Act, 2016.

Recovery of liquor is alleged from the house of the petitioner. Petitioner has stated on oath that he has got no criminal antecedent.

Submission is that house is occupied by the other family members also. Petitioner is in custody since 21.01.2019. Considering the aforesaid fact, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below

Patna High Court CR. MISC. No.20300 of 2019(2) dt.10-04-2019 2/2 where the case is pending in connection with Special Case No.813 of 2019 arising out of Barh P.S. Case No.38 of 2019 with following conditions :

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court below.

(b) The petitioner shall fully cooperate with the investigation / trial of the case, failing which the Court below shall be at liberty to cancel the bail bond of the petitioner. (Birendra Kumar, J) sanjeev/- U T
