JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 02-05-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State The petitioner apprehends his arrest in connection with Madanpur P.S. Case No. 177 of 2015 registered under Sections 147, 148, 149, 121(A), 386 and 120(B) of the Indian Penal Code and Section 17 of C.L.A. Act.

Learned counsel for the petitioner submits that it would appear from the FIR that in course of raid three persons namely, Rambali Yadav, Navin Prasad and Nagendra Mishra were apprehended by the police who disclosed the name of the petitioner and three others. Further submission is that in fact the petitioner is a student of M.A. Journalist Mass Communication,

Patna High Court Cr.Misc. No.13417 of 2017 (2) dt.02-05-2017 2/2 session of 2015-17 of Nalanda Open University, Patna and he wrote several articles for newspaper and magazine against the police atrocities and due to that reason, the petitioner has falsely been implicated by the police in this case.

Considering the aforesaid submissions, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad connection with Madanpur P.S. Case No. 117 of 2015, subject to the condition as laid down under Section 438(2) of the Cr.P.C. (Rajendra Kumar Mishra, J) Ravi/- U T
