The contempt application has been filed alleging willful disobedience of the order dated 20.09.2012 passed in C.W.J.C. No. 17459 of 2012.
The said writ application was disposed of with a direction to the respondents to ensure that revision of pension in terms of ACP and also difference of arrears of pension, gratuity and unutilized leave on the basis of the said grant of ACP are made within a period of four months.
In the show cause filed on behalf of the opposite parties, it is stated that the petitioner has already been granted two A.C.Ps. with effect from 09.08.1999 and he is not entitled to 3rd ACP, as the MACP Scheme has come from 01.01.2009 whereas the petitioner has retired on 31.05.2004.
Patna High Court MJC No.3368 of 2013 (4) dt.07-09-2016 In the above circumstances, there does not appear to be any violation of the order of this Court.
