JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 03-10-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 25(1-b)a, 26 of the Arms Act. One country made katta, one live cartridge, rupees five thousand in cash and one mobile are said to have been recovered from the house of petitioner and according to para-3 of the petition, petitioner does have criminal antecedent of four cases but submission on behalf of the petitioner is that the petitioner was arrested in connection with present case on 01.04.2016 and after that he was made accused in all the four cases which have been mentioned at para-3 of the petition. It is further pointed out that all

Patna High Court Cr.Misc. No.40507 of 2016 (2) dt.03-10-2016 2/2 the aforesaid four cases mentioned at para-3 of the petition had been lodged against unknown person. Moreover, prior to institution of the present case, petitioner had not been made accused in any other case.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bettiah, West Champaran in connection with Shikarpur P.S. Case No. 152 of 2016.
