The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 341, 323, 324, 447, 325, 307, 354(B) and 504 of the Indian Penal Code.

It is a case assault upon the members of the informant side by the accused persons as a result of which, they sustained injury and the accused persons also tried to outrage the modesty of the informant's wife, namely, Aisha Khatoon. It is submitted by learned counsel for the petitioners that the petitioners have falsely been implicated in this case. He

Patna High Court CR. MISC. No.33948 of 2021(2) dt.28-02-2022 2/2 further submits that the petitioners have not been apprehended at the spot. He further submits that the injury report annexed as Annexure-2 to the petition shows that all injuries are simple in nature and the case has been compromised between the parties. Petitioners have clean antecedent as stated in para-3 of the petition.

Learned APP appearing for the State has opposed the prayer for anticipatory bail.

In the facts and circumstances of the case, let the petitioners, above named in the event of their arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned CJM, Bettiah, West Champaran in connection with Yogapatti (Nawalpur O.P.) P.S. Case No. 346 of 2020, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
