====================================================== CORAM: HONOURABLE MR. JUSTICE HARISH KUMAR ORAL ORDER 15-05-2026 Heard Mr. Vinod Kumar, learned Advocate for the petitioner and Mr. Satyendra Narayan Singh, learned Additional Public Prosecutor for the State.
2. The application is filed for modification of the order dated 13.12.2023 passed in Criminal Miscellaneous No. 58518 of 2023 whereby the petitioner has been extended the privilege of anticipatory bail.
3. Learned Advocate for the petitioner submitted that since the petitioner had gone to Delhi with his well-wishers to work in private firm and got his job there and was not aware of the aforesaid order of the Hon'ble Court, therefore, he could not
Patna High Court CR. MISC. No.28662 of 2026(2) dt.15-05-2026 2/3 surrender within the period stipulated and furnished the bail bond. However, he submits that the petitioner is ready to pay the cost for the default made by him and inconvenience caused to this Court.

Mr. Satyendra Narayan Singh, learned Advocate for the State vehemently opposed the prayer and submits that the latches on the part of the petitioner is quite apparent, which takes away the plea of sympathy in view of the fact that the bail was granted to him way back on 13.12.2023 and now more than two years and five months have been lapsed, and now he approached this Court for extension of time to surrender and furnish bail bonds.
5. This Court finds substance in submissions made by learned Advocate for the State. True it is that the allegation, prima facie, appears to be matrimonial in nature, but this fact cannot be ruled out that the petitioner has filed the bail application sometime in the month of August, 2023 and the prearrest bail was extended to him on 13.12.2023, with a clear stipulation that he shall surrender and furnish his bail bond within four weeks'. More than two years have been lapsed and thereafter, this modification application has been filed, hence this Court does not incline to modify this order dated
Patna High Court CR. MISC. No.28662 of 2026(2) dt.15-05-2026 3/3 13.12.2023 on account of sheer latches and default on the part of the petitioner. However, if the petitioner shall surrender before the Court below within a period of four weeks', without being prejudice by the order of this Court, necessary order shall be passed in his regular bail application, without there being any unnecessary delay.
