The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 8, 20(b)(ii)(B) and 25 of the Narcotic Drugs and Psychotropic Substances Act, 1985.

Allegation is that the petitioner was having a room on rent in the house of Shesh Nath Prasad and from that room Ganja was recovered to the extent of 9 Kg. and odd. Submission of the petitioner is that the petitioner is not a resident of that house from where recovery was made and has been falsely implicated.

Considering the, prima facie, material against the petitioner and nature of allegation, I am not inclined to enlarge the

Patna High Court Cr.Misc. No.9755 of 2017 (3) dt.21-04-2017 2/2 petitioner on anticipatory bail in connection with N.D.P.S. Case No. 23 of 2016 arising out of Mohania Police Station Case No. 587 of 2016 pending in the Court of learned Sessions Judge-cumSpecial Judge, Kaimur at Bhabua. Hence, prayer for bail is refused.
