2. The petitioner is apprehending his arrest in connection with Majhauliya P.S. Case No. 509 of 2020 registered under Sections 366(A), 363, 506/34 of the Indian Penal Code.

3. As per prosecution case, the petitioner has kidnapped the minor sister of the informant for the purpose of marriage or for any other illegal purpose.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in the present case. He further submits that the real date of birth of the victim is 15.09.2001 which is mentioned in the Aadhar Card and at the time of occurrence, she was major. Learned counsel for the petitioner further submits that the victim girl in her

Patna High Court CR. MISC. No.20921 of 2025(5) dt.03-12-2025 2/2 statement recorded under Section 161 of the Cr.P.C. has clearly stated that she is major and she left her house on her own sweet will and also solemnized marriage with the petitioner.

5. Learned APP for the State has opposed the prayer for anticipatory bail of the petitioner.

6. The victim girl in her statement recorded under Section 164 of the Cr.P.C. has stated that she has solemnized marriage with the petitioner and is residing with him.

7. Considering the aforesaid facts and circumstances, let the petitioner, above named, in the event of arrest/surrender before the learned court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Betiah, West Champaran, in connection with Majhaulia P.S. Case No. 509 of 2020, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure/ 482(2) of the BNSS, 2023.
