JUSTICE MOHIT KUMAR SHAH ORAL ORDER 01-07-2020 The present petition has been taken up for consideration through the mode of Video Conferencing in view of the prevailing situation on account of COVID-19 Pandemic. Heard the learned counsel for the petitioner the learned APP for the State.

The petitioners seek regular bail in connection with Neema Chandpura PS case no. 09 of 2020 instituted for the offences punishable under Sections 147, 149, 341, 323, 307, 504, 506 of Indian Penal Code.

The allegation is regarding the accused persons including the petitioner herein having arrived at the door of the house of the informant on 24.02.2020 at about 8.30 am and had assaulted the petitioner herein.

The learned counsel for the petitioner has

No.21324 of 2020(2) dt.01-07-2020 2/2 submitted that the petitioner is innocent, has been falsely implicated in the present case, is having clean antecedent and is languishing in custody since 18.03.2020. The learned counsel for the petitioner, by referring to paragraph no. 9 of the present petition, has submitted that the injuries found on the person of the informant have been stated to be simple in nature, upon examination by the doctor.

Having regard to the facts and circumstances of the case, considering the submissions made by the learned counsel for the parties and taking into account the period of incarceration of the petitioner herein, apart from the fact that the petitioner is having a clean antecedent, the abovenamed petitioner is directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.- XIII, Begusarai in connection with Neema Chandpur PS case no. 9 of 2020.
