JUSTICE JYOTI SARAN ORAL ORDER 19-02-2016 The limited prayer of the petitioner in the present writ petition is that on the failure of the builder/developer to register her flat bearing No.14-B, Bimla Tower, New Punichak in the town and district of Patna the petitioner applied before the Municipal Commissioner, Patna Municipal Corporation under the provisions of the Bihar Apartment Ownership Act, 2006 for completing the formality of registration as back as in 2012, copies of which are present at Annexures-7 and 8 but which have remained pending for the last more than three years. Learned counsel for the petitioner has referred to a direction issued by the Estate Officer, Patna Municipal Corporation present at Annexure-9 to the Supplementary

Patna High Court CWJC No.14222 of 2013 (2) dt.19-02-2016 Affidavit to submit that whereas in similar circumstances the Estate Officer, Patna Municipal Corporation has issued necessary directives to the District Sub-Registrar, Patna but the grievance of the petitioner remains pending.

I have heard Mr. Gajendra Kumar Singh for the petitioner and Mr. Saket Tiwary for the Patna Municipal Corporation and considering the nature of grievance I deem it fit and proper to dispose of the writ petition with a direction to the Municipal Commissioner, Patna Municipal Corporation to consider the grievance of the petitioner present at Annexures-7 and 8 to the writ petition and pass appropriate orders bearing in mind the directives present at Annexure-9. Since the matter is pending for quite some time hence a disposal within a period of three months from the date of receipt/production of a copy of this order would be appreciated.
