JUSTICE MOHIT KUMAR SHAH ORAL ORDER 16-08-2019 In compliance of the order of this Court dated 15.05.2019, an affidavit has been filed on behalf of respondent no. 5, wherein it has been stated that the premise in question, has been handed over to the petitioners herein, hence nothing survives for consideration in the present writ petition. This statement made by the respondent no. 5, in his affidavit filed today, is not disputed by the learned counsel for the petitioners.

At this juncture, the learned counsel for the petitioners submits that the original proceeding register of Arya Samaj Mandir was handed over to the learned counsel appearing for the Union of India, as such, the learned counsel for the petitioners prays that the same may be directed to be returned back to him. If that be so, the learned counsel for the Union of India shall return back the said register within one week from today, for which purpose the learned counsel for the petitioners shall approach the learned counsel for the respondent-Union of India.
