JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 17-09-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-47/54 of the Bihar Excise (Amendment) Act, 2016. In huge quantity, Indian made foreign liquor was recovered from a Scorpio and the occupants of the Scorpio managed to flee from the place of occurrence. However, in course of investigation, it came to light that the petitioner was driver of the aforesaid Scorpio.
Submission on behalf of petitioner is that the seized liquor does not belong to the petitioner and as a matter of fact, some unknown persons hired the vehicle of the petitioner and when police intercepted the aforesaid vehicle, the above-said

No.38620 of 2016 (2) dt.17-09-2016 2/2 persons fled away from there leaving behind the Scorpio and the petitioner also fled away from there out of fear but subsequently, he voluntarily, surrendered before the court below and, is languishing in jail custody since 22-07-2016. Considering the above-said facts and circumstances of the case as well as submission of the parties and also, taking note of this fact that the petitioner does not have any criminal antecedent, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Dumraon P.S. Case No. 118 of 2016 to the satisfaction of learned Chief Judicial Magistrate, Buxar.
