1. The petitioner is guilty of very as suggestio false side.

2. As pointed out by the learned counsel for the respondent, the enquiry is pending against the petitioner, wherein second show cause has already been issued. These facts have been withheld in the writ petition filed by the petitioner, who claims promotion on the basis that junior persons to her have been promoted.

3. Since there is a departmental enquiry pending

Patna High Court CWJC No.14482 of 2015(2) dt.21-02-2023 2/2 against her, she could not have been promoted. It is also informed that she has since superannuated, but all these facts have not been mentioned by her in the writ petition.

4. Keeping in view aforesaid, the writ petition is dismissed.
