In this case, the petitioner is seeking anticipatory bail in connection with Khaira P.S. Case No.248 of 2015, registered for the offence punishable under Section 307/34 of the Indian Penal Code.

As per the F.I.R. the informant was called by the petitioner at the main road, where Sanjit Pandey was already there, the petitioner snatched his mobile, whereafter, the informant returned back to his house. On the next day, the petitioner again came to the house of the informant and told him to come with him for taking his mobile and brought him on motor-cycle and carried to Jhundo and there with an intention to

No.19574 of 2017 (5) dt.19-07-2017 2/2 kill him has pressed his neck, as a result of which, the informant became senseless, when he regain his sense, found himself in the clinic of Jawahar Prasad Singh, whereafter he was brought to Patna for treatment and admitted in Chankya hospital. Learned counsel for the petitioner submits that the injury is simple is nature.

Learned counsel for the informant has appeared and file counter affidavit, in which he has attached the volumes of the documents, showing his treatment at Chankya hospital and submitted that the informant is still in bed on account of the injury.

Looking to the nature of allegation, this Court is not inclined to grant bail to the petitioner. Accordingly, the prayer for bail is rejected.
