The petitioner seeks regular bail in connection with Sadar P.S. Case No. 148 of 2021 instituted for the offences under Sections 419, 420 and 349 of the Indian Penal Code read with Section 10 of the Bihar Examination Control Act, 1981. Learned counsel for the petitioner submits that the petitioner is in custody since 21.02.2021, charge-sheet has been submitted in the case and is a person with clean antecedent Learned counsel for the petitioner submits that from bare perusal of the allegation as alleged in the F.I.R. it would manifest that informant has alleged that in the I.B.P.S. and C.R.P.O. examination conducted at I.D.Z. Bhagwanpur Centre it

Patna High Court CR. MISC. No.31146 of 2021(2) dt.25-11-2021 2/3 was found that some examinees including the petitioner changed their seats instead of sitting in their allotted seats. Further, they were sitting in pair and were wearing identical dress and changed their seats with each other for the purpose of cheating. Thereafter, the police arrived and they were arrested. Learned counsel for the petitioner submits that coaccused Shambhu Kumar, Akash Deep, Shubham Kumar and Navin Paswan have been granted bail vide order dated 09.07.2021 in Cr. Misc. No. 29864 of 2021. Further the coaccused Sanjeet Kumar has been granted bail vide order dated 09.07.2021 in Cr. Misc. No. 31287 of 2021 and co-accused Vikash Kumar @ Manish Kumar Gupta and Kumar Abhishek have also been granted bail vide order dated 28.07.2021 in Cr. Misc. No. 32023 of 2021 and vide order dated 09.07.2021 in Cr. Misc. No. 29771 of 2021 respectively.

Learned A.P.P. for the State vehemently opposes the prayer for regular bail of the petitioner.

Considering the fact that the petitioner is in custody since 21.02.2021, charge-sheet has been submitted in the case and the petitioner is a person with clean antecedent, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand only) with two
