Petitioner seeks bail in a case registered for the offences punishable under Sections 399, 402, 414 of the Indian Penal Code and Sections 25(1-b)a, 26, 35 of the Arms Act. Petitioner and some others were caught while they had assembled to make preparation for committing dacoity and on being searched, one country made loaded pistol and two live cartridges were recovered from possession of the petitioner. Submission on behalf of the petitioner is that petitioner is in jail custody since 17.02.2016 and having more or less similar allegation, co-accused, Komal Gope has already been

Patna High Court Cr.Misc. No.38796 of 2016 (2) dt.20-09-2016 2/2 granted privilege of bail by a co-ordinate Bench of this Court vide order dated 20.08.2016 passed in Cr. Misc. No. 35871 of 2016. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Nalanda, Biharsharif in connection with Silao P.S. Case No. 26 of 2016.
