2. The petitioner seeks bail in connection with Kundwa Chainpur P.S. Case No. 178 of 2023 registered for the offence under Section 302 of the Indian Penal Code and under Section 27 of the Arms Act.

3. From the statememt of one co-accused Pradeep Kumar, it is Pradeep Kumar and Aryan who have killed the deceased. Mukul Kumar is also said to have been involved in the killing of the deceased.

4. It has been submitted by the learned counsel for the petitioner that the petitioner is innocent and he is in jail since 12.12.2023.

5. Considering the aforesaid facts, this application is allowed.

6. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Sikrahna at Dhaka, East Champaran, Motihari /concerned Court below in connection with Kundwa Chainpur P.S. Case No. 178 of 2023.

7. As a condition of this order, the petitioner after being released on bail is directed to mark his attendance at Dhaka (East Champaran) Police Station on every Sunday of each month. Any default in appearance at the police station will result in cancellation of bail bonds of the petitioner.

8. As a condition of this order, the petitioner, after being released on bail is directed to co-operate in the trial either by appearing personally or through his lawyer in the trial Court on each and every date fixed by the trial Court. Non-compliance of the condition will result in cancellation of the bail bonds of the petitioner.
