2. Petitioner seeks regular bail in connection with Rajnagar P. S. Case No. 167 of 2024 in a case registered for the offences punishable under Sections 417, 420, 467, 468, 471/34 of the Indian Penal Code.
3. Prosecution case, in brief, is that this petitioner showed a piece of land to the informant to purchase and when informant purchased the same, later on, it was detected that the said land was already sold to some other person. It is alleged that during transaction, informant had credited Rs. 10 lacs to the account of this petitioner.
4. Learned counsel for the petitioner submits that
Patna High Court CR. MISC. No.24008 of 2025(3) dt.11-07-2025 2/2 petitioner is innocent and has committed no offence. As a matter of fact, petitioner has sold her land to co-accused Nandan Kumar Jha who sold the same land to informant vide sale deed dated 23.03.2021 and F.I.R. has been lodged on 22.05.2024 i.e. after inordinate delay of about three years without any plausible explanation. By filing supplementary affidavit, learned counsel for the petitioner, lastly, submits that petitioner is ready to deposit/pay Rs. 10 lacs in easy installments which have been transferred to his account. Petitioner is in custody since 17.01.2025.
5. Learned A.P.P. for the State as well as learned counsel for the informant vehemently opposed the bail application.
6. Considering the nature of accusation, prayer for bail of the petitioner is rejected.
