The petitioner apprehends his arrest in Complaint Case No. 87C/2014, registered for the offences punishable under Section 420 of the Indian Penal Code and 138 of the Negotiable Instruments Act.

Learned counsel for the petitioner submits that the petitioner is ready to return the entire amount i.e., Rs. 1,50,000/- within two months from the date of this order. Mr. Anil Chandra learned counsel appearing on behalf of the complainant did not have any objection if the money is returned.

No.44692 of 2015 (3) dt.21-12-2015 2/2 Considering the facts aforesaid, the petitioner, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-divisional Judicial Magistrate, Nalanda at Biharsharif in connection with Complaint Case No. 87C/2014, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.

Subject to the condition that petitioner shall deposit the entire amount within two months from today, if the petitioner fails to deposit Rs. 1,50,000/- within the stipulated period learned court below shall cancel the bail bond.
