JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 23-11-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Earlier prayer for bail of the petitioner was rejected by this court but submission on behalf of petitioner is that having more or less similar allegation, several persons have already been granted privilege of bail and, moreover, in course of investigation, it came to light that it was the co-accused Nata, who committed the murder of the deceased and so far as petitioner and other accused are concerned; they only helped in disposal of dead body of the deceased.
The trial court has reported that charge against the petitioner and others has already been framed and uptill now, only three prosecution witnesses could be examined.
Patna High Court Cr.Misc. No.41419 of 2016 (3) dt.23-11-2016 2/2 Considering the stage of trial as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Nawada Town P.S. Case No. 261 of 2014 corresponding to Sessions Trial No. 315 of 2014 to the satisfaction of Learned Additional Sessions Judge-Ist, Nawada.
