JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 27-08-2020 Heard Mr. Umesh Chandra, learned Counsel for the petitioner, Mr. Ranjan Kumar Jha, learned counsel for the informant and Mr. Nityanand Tiwary, learned Additional Public Prosecutor for the State.
The petitioner is in custody in connection with Pipra P.S. Case No.309 of 2019 registered for the offences under Section 392 of the IPC.
Learned counsel appearing on behalf of the petitioner would submit that the petitioner is in custody on remand in this case since 28.11.2019.There is no recovery of anything incriminating from the possession of the petitioner. The petitioner has not been put on Test Identification Parade. Considering the fact that the petitioner was not named in the FIR and he has remained in custody since 28.11.2019, the
Patna High Court CR. MISC. No.22538 of 2020(2) dt.27-08-2020 2/2 Court is inclined to grant bail to the petitioner. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 50,000/- (Fifty Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Motihari, East Champaran , in connection with Pipra P.S. Case No.309 of 2019.
On release, the petitioner shall render his services as a volunteer for a period of one month in the dedicated Covid-19 hospital and for which he is required to report to the Civil Surgeon/Nodal Officer of the concerned region, who shall appropriately utilize his services in the pandemic.
