JUSTICE SUDHIR SINGH ORAL ORDER 08-12-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 25(1-b)a, 26 and 35 of the Indian Penal Code. Allegation against petitioner is that he was apprehended while he was trying to flee away and on search, arms were recovered from his possession.
It has been submitted on behalf of petitioner that he is in custody since 21.5.2016. He has falsely been implicated in the present case. No allegation of tampering of witnesses is alleged against petitioner. It is alleged that one country made pistol along with six cartridges has been recovered. No compliance of Section 100 of the Code of Criminal Procedure is made. On behalf of the State, it is submitted that petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial
