JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 01-06-2017 Heard counsel for the petitioner and the State. The petitioner is apprehending his arrest in connection with Dehri (Indrapuri) P.S. Case No. 210 of 2015 for the offence under Sections 379, 411 and 120(B) of the Indian Penal Code, Section 40(1-a), 21(1) of D.E. Act, Section 40(i) of B.M. Act and Sections 33, 41 and 42 of the Forest Act. The petitioner is the son of the owner of the tractor, which was loaded with stone chips. It appears from the F.I.R. that the allegation is of carrying stone chips without proper documents. The name of the petitioner surfaced as the owner of the tractor, whereas, the statement made in para 7 of the petition, which reads as under:- "That the aforesaid vehicle which is said to have

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the SDJM, Dehri Rohtas or his successor Court in connection with Dehri (Indrapuri) P.S. Case No. 210 of 2015, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
