Learned counsel for the opposite party no.2 has appeared on notice and submits that the petitioner's name surfaced only on the confessional statement made before the police which has no evidentiary value. As such, the petitioner has misused the privilege of bail and it is on mere confessional statement on which petitioner is praying for cancellation of the earlier order in favour of petitioner. In the aforesaid facts and circumstances there is no merit in this application and hence dismissed.
