The petitioner invoking inherent jurisdiction of this Court under Section 482 of the Code of Criminal Procedure 1973 has prayed for quashing of an order dated 19.2.2013 passed by learned Chief Judicial Magistrate , Begusarai (hereinafter referred to as "Magistrate") in Sahebpur Kamal P.S. Case No. 32 of 2010. By the said order the learned Magistrate has framed charges for offences under Section 324/34, 326 / 34 of the Indian Penal Code and Section 27 of the Arms Act .
Learned counsel for the petitioner tried to persuade the court that there was no material for framing of charges. He further
Patna High Court Cr.Misc. No.22511 of 2013 (3) dt.07-12-2016 2/2 submits that while framing charge the learned Magistrate has not assigned any reason.
Fact remains that in this case charge was framed long back in the year 2013. In a criminal case after framing of charge trial commences. Once trial has commenced there is no reason for this court to interfere with the matter.
The petition stands dismissed.
