JUSTICE DINESH KUMAR SINGH ORAL ORDER 07-01-2015 Heard learned counsels for the petitioner and the State. The petitioners are apprehending arrest in a complaint case in which process has been directed to be issued after cognizance being taken for the offences punishable under Sections 323, 380, 504, 452 and 436/34 of the Indian Penal Code. The prosecution case is of entering into the house of the complainant, assaulting his wife with fist and slaps and setting the house of the complainant on fire.

It is submitted by learned counsel for the petitioners that for the occurrence of 02.01.2013, the complaint was filed on 16.01.2013 when Title Suit No. 293 of 2012 and the informatory petition were filed by the petitioners' at earlier point of time. A statement has been made in para 3 of the petition that the

Patna High Court Cr.Misc. No.161 of 2015 (2) dt.07-01-2015 petitioners have no criminal antecedent.

Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned J.M., 1st Class, Darbhanga in connection with C.R. Case No. 66 of 2013, subject to the conditions as laid down under Section 438(2) Cr.P.C.
