JUSTICE VINOD KUMAR SINHA ORAL ORDER 14-12-2018 The petitioner seeks regular bail in connection with Samastipur Town P.S. Case No. 08 of 2018, registered for offences punishable under Section 379 of the Indian Penal Code.
Allegation is of commission of theft of motorcycle of the informant, which was recovered from the petitioner on the confession of co-accused that he sold the motorcycle to the petitioner, on which, two stolen motorcycles were recovered from the petitioner.
It has been submitted on behalf of the petitioner that from the F.I.R. itself it is evident that the petitioner is not involved in the commission of theft of motorcycle rather the recovered motorcycles were purchased by him without
Patna High Court Cr.Misc. No.73524 of 2018(2) dt.14-12-2018 2/2 knowing the fact that the motorcycles were stolen ones. Further, he has no criminal antecedent and has been in judicial custody since 19.06.2018.

Having heard both sides, in view of the above facts, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Samastipur, in connection with Samastipur Town P.S. Case No. 08 of 2018, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
