The petitioner, who is in custody since 31.01.2020 and is a person of clean antecedent, seeks bail in connection with Turkauliya (Banjariya) P.S. Case No. 439 of 2019 dated 03.07.2019 instituted for the offences under Sections 272 and 273 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

It appears that 50 litres of liquor was recovered from the possession of the petitioner.

Learned counsel for the petitioner submits that he has got no concern with the seized items and he has falsely been implicated in this case.

Regard being had to the period of custody of

Patna High Court CR. MISC. No.21097 of 2020(2) dt.29-06-2020 2/2 the petitioner and nature of accusation against him, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 9th Additional Sessions Judge-cum-Special Judge, Excise, Motihari, East Champaran in connection with Turkauliya (Banjariya) P.S.
