The petitioners are apprehending arrest in a case registered for the offences punishable under sections 436,295(a) and 120B of the Indian Penal Code.

The accusation is of litting fire to the godown of the informant.

It is submitted that the accusation has been levelled in the background of serious title dispute. Title Suit No. 38 of 2011 is also pending and as per accusation no offence under section 436 IPC is made out as the alleged godown has not been claimed to be a dwelling house. This has not been controverted by the learned APP that co accused has been granted regular bail by the learned court below.

Patna High Court Cr.Misc. No.3213 of 2015 (2) dt.27-01-2015 2/2 This court sees no reason for the learned court below not to consider prayer for regular bail of the petitioner in case the petitioner surrenders within six weeks from today in connection with Kishanganj P.S. Case No. 527 of 2014 pending in the court of learned CJM, I/C, Kishanganj.

This application is disposed of with the aforesaid observation/direction.
