2. The petitioner is in custody since 23.08.2016 in connection with L.N.M.U. P.S. Case No. 61 of 204 for the alleged offences under Sections 457 and 380 of the Indian Penal Code.

3. The bail petition of the petitioner was disposed of by the learned Ist Additional Sessions Judge, Darbhanga by order dated 22.09.2016 with the observation that "if the trial is not concluded within a period of 60 days from the first day of taking evidence in that case and if he is not released on bail by the trial Court, accusedpetitioner is at liberty to move before this Court".

4. Having regard to the nature of the aforesaid observation, this Court is not inclined to consider the prayer for grant of bail of the petitioner on merits. The petitioner may be at liberty to move the appropriate Court for grant of bail, which shall be disposed of on its own merits.
