The petitioner apprehends his arrest in Patepur P.S.Case No.56 of 2016, registered for the offences punishable under Sections 366A, 365 and 34 of the Indian Pena Code. The informant initially filed a complaint case, alleging therein that the petitioner and others kidnapped her minor daughter. On the basis of such complaint petition, the present F.I.R. was filed.

The learned counsel for the petitioner submits that the victim made her statement under Section 164 of the Cr.P.C. and she disclosed that she voluntarily left her house and out of her free will solemnized marriage with the petitioner and she was not kidnapped by person. The victim disclosed her aged to be 19 years

Patna High Court Cr.Misc. No.10511 of 2017 (2) dt.15-03-2017 2/2 and the court also assessed the age of the victim to be 18 years. Considering the facts aforesaid, the petitioner above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Sub Judge-XI-cum-Additonal Chief Judicial Magistrate, Xth, Vaishali in connection with Patepur P.S.Case No.56 of 2016 dated 01.07.2016, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
