The petitioners apprehend their arrest in a case registered for the offence under Section 302/34 of the Indian Penal Code.

The informant suspects that these petitioners alongwith other F.I.R. named co-accused persons committed the murder of his daughter and hanged her dead-body on mango tree blaming her for having illicit relation with co-accused Md. Nasar.

Petitioners have been made accused in this case merely because they are full brothers of husband of deceased. Bare perusal of F.I.R. goes to show that deceased was having illicit relation with son of co-accused Md. Safique namely Md.

Patna High Court CR. MISC. No.23090 of 2022(4) dt.28-11-2022 2/2 Nasar and the dead-body was found hanging with mango tree in the orchard of co-accused Md. Safique. Petitioners are separate in mess and property and have got no concern with the affairs of couple and merely on suspicion, they have been made accused in this case. Petitioners have got clean antecedent. Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, let the above named petitioners, in the event of their arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M. - I, Araria in connection with Bousi P.S. Case No. 130 of 2021, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Singh, J) anay/- U T
