The petitioners apprehend their arrest in a case registered for the offence under Section 307 & other allied sections of the Indian Penal Code.

As per the prosecution case, petitioner no. 2 assaulted with sword on the head of the informant and so far as petitioner no. 1 & 3 are concerned, there is no specific allegation of overt act.

It is submitted that present case is counter blast of Dhanarua P.S. Case No. 246 of 2021. Both sides sustained injury. Though, there is allegation of assault by petitioner no. 2, but doctor has not expressed any opinion about the nature of injury. Petitioners have no criminal antecedent.

Patna High Court CR. MISC. No.22770 of 2022(2) dt.31-08-2022 2/2 Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, let the above named petitioners, in the event of their arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Masaurhi, Patna in connection with Dhanarua P.S. Case No. 247 of 2021, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
