JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-01-2017 The petitioner is in custody since 02.02.2015 in connection with Mejarganj P.S. Case No. 13 of 2015, registered for offences punishable under Sections 302, 307, 120B/34 of the Indian Penal Code.
It has been submitted on behalf of the petitioner that though there is direct allegation against the petitioner, however he has been languishing in judicial custody for about two years and, therefore, a lenient view may be taken and he may be granted the privilege of regular bail.
Learned A.P.P. for the State has submitted that in this case trial is going on and out of thirteen witnesses eight witnesses along with informant, have already been examined. Heard the parties, in view of the submission of learned

No.53481 of 2016 (3) dt.25-01-2017 2/2 counsel for the State that in this case trial is going on and out of thirteen witnesses, eight witnesses along with informant, have already been examined, I am not inclined to grant the petitioner, the privilege of regular bail, it is accordingly rejected. However considering the fact that the petitioner is in judicial custody for about two years, learned court below is directed to expedite the trial and try to conclude it as early as possible.
