Petitioner's prayer for bail was earlier rejected by this Court on 12.04.2018 (Annexure 1).
Learned counsel for the petitioner has referred to subsisting intimate relationship with the informant and has submitted that the case is one of false implication. The report from the Court below was called for regarding the stage of trial. The same discloses that uptill now not even a single chargesheeted witness has been examined in the trial. The charges were framed against the accused persons on 30.05.2018. It is further taken note of that prior to the instant case, as per averments made in this application, petitioner has
Patna High Court CR. MISC. No.71924 of 2018(3) dt.17-04-2019 2/2 no criminal antecedent and that he is in custody since 08.12.2017 that is almost one and half years. Having considered the aforesaid facts and circumstances, prayer for bail of the petitioner is allowed. Let the petitioner above named be released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate II, Patna City, Patna in Bahadurpur Police Station Case No 247 of 2017 subject to the following conditions:
(1) That one of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the petitioner.
(2) That the petitioner will be well represented on each date in the trial and if he fails to do so on two consecutive dates, his bail will be liable to be cancelled. (Madhuresh Prasad, J) M.E.H./- U T
