JUSTICE SATYAVRAT VERMA ORAL ORDER 06-05-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State through virtual Court proceedings. The petitioner seeks bail in a case registered for the offences punishable under Sections 272, 273, 420, 120(B) and 34 of the Indian Penal Code read with Section 30(a) of the Bihar Excise Act.
Learned counsel for the petitioner submits that the petitioner is in custody since 25.02.2022, is a person with clean antecedent and charge-sheet has been submitted in the case. Allegation is of recovery of 265.80 litres of liquor from a pickup van.
Learned counsel for the petitioner submits that the petitioner was not arrested from the spot and his name transpired in the confessional statement of co-accused Manoj
Patna High Court CR. MISC. No.23026 of 2022(2) dt.06-05-2022 2/2 Kumar Rai which has no evidentiary value.
Learned A.P.P. for the State opposes the prayer for bail of the petitioner.
Considering the fact that the petitioner is in custody since 25.02.2022, is a person with clean antecedent, chargesheet has been submitted in the case, he was not arrested from the spot and his name transpired in the confessional statement of co-accused, let the petitioner above named be released on bail on furnishing bail bond of Rs. 5,000/- (Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Siwaipatti P.S.
