The application is for grant of anticipatory bail for the offence under Sections 147, 148, 149, 323, 307, 447 and 504/34 of the Indian Penal Code.

It is submitted on behalf of the petitioner that though there are allegations against the petitioner that he assaulted with 'Farsa' on the younger brother of the informant but no definite opinion has been given about the injury by the Medical Officer and there is a case and counter case between both the parties. It is also submitted that there is land dispute between the

Heard learned counsel for the informant and the learned A.P.P. also.

In view of the submission of the learned counsel for the petitioner that there is a case and counter case due to land dispute between the parties with regard to construction of house and also submission on behalf of the petitioner that no definite opinion has been given about the injury report, let the petitioner surrender before the court below and the court below will examine the injury report and other aspects of the matter and thereafter will pass appropriate order without being prejudiced of the order of this Court preferably on the same day. With the aforesaid observation, this application is dismissed.
