The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 307 and 504/34 of the Indian Penal Code.

The prosecution case is that while the informant was making Aar in his land, the petitioner came and made protest and, thereafter, abused and assaulted the informant with spade. On alarm being raised, the informant's father, wife and brother's wife came to rescue then they were also assaulted by co-accused Nawlesh Yadav, Mahendra Yadav and Rajendra Yadav. It is submitted by learned counsel for the petitioner that specific accusation against the petitioner is making assault

Patna High Court Cr.Misc. No.44950 of 2015 (3) dt.02-11-2015 2/2 with spade to the informant but the injury has been found superficial simple in nature caused by hard and blunt substance. Considering the accusation being not corroborated with medical opinion, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Nawada in connection with Pakribrawan P.S. Case No.157 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
