JUSTICE VINOD KUMAR SINHA ORAL ORDER 23-12-2016 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.

This is an application for grant of regular bail for offences punishable under Sections 506, 504 and 387 of the Indian Penal Code.

It has been submitted on behalf of the petitioner that the petitioner has not been named in the First Information Report, his name transpired during the course of investigation on the confessional statement made by a co-accused and there is nothing to connect the petitioner in this case and the petitioner has been in custody since 16.08.2016.

Heard learned A.P.P. also.

Having heard both sides. In view of the fact that petitioner's name surfaced in this case only on account of

No.55498 of 2016 (2) dt.23-12-2016 2/2 confessional statement of co-accused and there is nothing against the petitioner and he has been in judicial custody since 16.08.2016, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 10,000 (Rs. Ten Thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M. Jamui, in connection with Khaira P.S. Case No. 176 of 2016 with the condition that one of the bailors of the petitioner, shall be a close relative having sufficient means within the territorial jurisdiction of the concerned Court and shall fully cooperate with the investigation or trial, as the case may be.
