JUSTICE SANJAY PRIYA ORAL ORDER 20-03-2017 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in Chainpur P.S. Case No. 223 of 2016 instituted for the offence under section 47(A) of the Bihar Excise Act.

It is alleged that two liters of country made liquor has been recovered from the kitchen of the petitioner. The petitioner managed to run away.

From the seizure list, enclosed with the written report, it appears that there is no signature of either this petitioner or any of the family members of petitioners on the seizure list. Although, it is alleged that the liquor has been recovered from the kitchen of this petitioner but it is submitted that there is no compliance of provision of Section 100(6) Cr.P.C. It is mentioned in para-3 of the petition that the

Patna High Court Cr.Misc. No.11649 of 2017 (2) dt.20-03-2017 2/2 petitioner has no criminal antecedent.

Considering the facts and circumstances of the case, prayer for anticipatory bail of the petitioner is allowed. In the event of surrender/arrest of the petitioner named above, within six weeks from today, in connection with Chainpur P.S. Case No. 223 of 2016,he shall be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Kaimur at Bhabhua, subject to the conditions as laid down under Section 438(2) Cr.P.C (Sanjay Priya, J) Ravi/- U T
